Further to our update on Friday 21 August regarding the Section 77 application, we have been advised that the court has provisionally listed the hearing for 2 September.
However, the court has not yet authorised the summons, and a council cannot legally serve a court summons before it has been authorised and issued by the court. The owners are legally entitled to a minimum of three clear days' notice of the hearing which excludes weekends and bank holidays. We have been repeatedly chasing this matter and understand that the summons is currently awaiting authorisation by the court's legal team.
Should the court grant the order, the 14-day compliance period will run from the date the order is made (which would be the date of the hearing, not from the date the application was submitted).
We remain in regular contact with the owner, who has advised us that a new scaffolding contractor will begin delivering the necessary materials today, with works due to commence on Friday.
