The role of Wyre Council:
Wyre Council holds powers under the Environmental Protection Act 1990 to deal with issues that constitute a statutory nuisance. These powers include investigating complaints, inspecting areas for potential nuisances, and serving abatement notices if a nuisance is determined. To action these powers, the Council must collect evidence to the standard required to satisfy the legal criteria for statutory nuisance.
If satisfied that a statutory nuisance exists the Council is required to issue an abatement notice to the person(s) responsible for the nuisance requiring that the nuisance be ‘abated’ within a specified time period.
Causing a statutory nuisance is not an offence in itself but not complying with an abatement notice without reasonable excuse is.
How you can help:
Your help is crucial to meet the level of evidence needed for Wyre Council to take action under its powers of statutory nuisance.
You can contribute to the Council’s investigation by providing evidence of how you are being impacted by odours from the Jameson Road Landfill site in your home, garden or workplace.
- Download odour diary sheets here Diary Sheets and complete these over at least 7 consecutive days to describe how the odour has impacted you. You must complete all fields within the diary sheet, including the date and duration of each odour impact, its intensity, and how it has interfered with the use and enjoyment of your property.
- Submit your diary sheets to Wyre Council. You will receive a response from a member of the council’s Environmental Protection Team.
- An officer will arrange to visit your property at an agreed time when the odour is most likely to be present. Such monitoring visits are necessary to enable the Council’s officers to witness the intensity and impact of the odour themselves in order that they can take forward a case of statutory odour nuisance on behalf of the community.
The evidence collated in the form of diary sheets and officer observations will be used to inform the Council’s ongoing investigation into odours from the site. We have created some odour diary sheet guidance which provides clear instructions on how you can complete the diary sheet as effectively as possible. - Please complete at least seven consecutive days (ideally 14) of entries, ‘no odour’ can be used for days with no impact
- Provide as much detail around the date and duration of the odour
- Provide as much detail around the ‘description of the event’ to show how the odour is interfering in the use and enjoyment of your property
- Only include information about the impact of the odour whilst at your property rather than when you are out and about in the community
- Ensure your diary sheet is signed with your name before you submit

Online form
The Council has also created an online form which you are able to use to log daily diary entries, should you prefer.
This form is to log one daily diary entry of how you have been impacted by odour from Jameson Road landfill, Fleetwood. You must complete at least seven consecutive days of diary entries for this to be used as evidence.
The role of the Environment Agency:
The Environment Agency is the primary regulator of waste activities under the Environmental Permitting (England and Wales) Regulations.
This means the Environment Agency is responsible for monitoring the day-to-day activity at Jameson Road Landfill by its operator, Transwaste Recycling and Aggregates Ltd.
The Environment Agency holds powers to take enforcement action if the operator is found to be in breach of its Environmental Permit. Enforcement action by the Environment Agency can result in suspension of activity on site.
