Business duty of care
Every business that produces waste in the UK has a legal ‘duty of care’ to:
- manage waste properly until it's recycled or disposed of
- use a registered waste carrier or register to carry your own waste
- keep the correct paperwork for at least two years
Business rates do not cover the removal of waste from business premises. If a business does not comply with this legislation, the local authority can serve a section 34 or 47 notice. A lack of understanding is not a defence in court.
