Notice of intention to dispose of Cleveleys asset of community value.

The council has received notification from Enterprise Inns PLC, the owners of The Sandpiper Public House of their intention to dispose of the land/property which is included on our List of Assets of Community Value.

The council has updated the list (available to view online) with the timescales of what must happen next. 

  • Interim moratorium ends on 2 October 2015 - six weeks from the notice of intention to dispose being received (21 August 2015) 
  • Full moratorium ends on 21 February 2016 - six months from the notice of intention to dispose being received
  • Protected period ends 21 February 2017 - 18 months from the notice of intention to dispose being received 

What this means 

During the interim moratorium, a community interest group can request in writing to the council to be treated as a potential bidder for the asset. This group must be one of the following: 
  • a charity 
  • a community interest company 
  • a company limited by guarantee that is non-proft distributing 
  • an industrial and provident society that is non-proft distributing 
Following the receipt of a written request to be treated as a potential bidder, the council will inform the owner of the asset that this request has been received. This request triggers a full moratorium, which prevents the owner from disposing of their asset for six months from the date on which the council received the notification of the intention to dispose of the asset. 

After the moratorium period (either six weeks if there has been no community interest notification to be treated as a bidder, or the full six months), the owner is free to dispose to whomever they choose and at whatever price. 

No further moratorium will apply for the remainder of the protected period, lasting 18 months from the date the owner notified the council of their intention to dispose of the asset.
